The Hearing Damian Thought He Owned

Chapter 14 - The Hearing Damian Thought He Owned

The guardianship hearing began in a crowded courtroom.

Damian arrived with four attorneys, two public-relations advisers, and a stack of medical files. Jake arrived in a clean black shirt borrowed from his apprentice. Mara sat beside Eleanor, who wore a pale blue dress and remained in her wheelchair.

Damian’s lead attorney spoke first.

He described Eleanor as loving but impaired, vulnerable to manipulation, and unable to understand complex financial decisions. He suggested Jake had developed an emotional fixation after the viral video. He suggested Mara returned only after learning the value of the trust.

Then he played the Bellweather consent video.

Eleanor watched herself answer questions under sedation.

When Tessa’s turn came, she called the independent neurologist. The doctor testified that Eleanor had mild language fatigue from her stroke but no dementia. She understood her finances, family relationships, and legal choices.

A second doctor agreed.

Simone testified about the medication schedule. Bellweather’s attorney attacked her credibility, pointing out that she had been fired for copying confidential records.

“I copied them because the originals were being changed,” Simone answered.

Mara testified that Damian told her Eleanor had died.

Damian’s attorney produced messages in which Mara had angrily written that she wanted nothing more to do with the family. The messages were real—but six years old, written after an argument over Samuel’s funeral.

The attorney presented them as recent.

Tessa exposed the dates.

The judge’s expression changed.

Then Damian took the stand.

He admitted creating the private funeral program, claiming it was part of “anticipatory grief counseling.” He admitted transferring Eleanor’s house but said he did so to prevent foreclosure. He denied forging signatures or ordering sedation.

“Everything I did,” he said, looking at the judge, “was to protect my mother.”

Tessa approached.

“Did protecting her include telling your sister she was dead?”

Damian’s jaw tightened. “Mara was unstable.”

“Did it include telling Bellweather to deny Eleanor access to a telephone?”

“I did not.”

“Did it include visiting Ruth Bell three days before this hearing?”

For the first time, Damian looked startled.

His attorney objected.

Tessa placed the visitor log on the screen.

Damian admitted the visit but claimed he went to thank Ruth for helping his father years earlier.

“Did you remove a signed will from her document box?”

“No.”

The courtroom door opened.

Ruth Bell entered with a police detective.

In her hands was a sealed plastic evidence bag.

Inside lay a charred envelope bearing Samuel Hayes’s name.

Ruth faced Damian.

“You took the wrong copy,” she said.
